These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Porcellino Artisanal Meats, LLC, a Colorado limited liability company (“Porcellino,” “Company,” “we,” “us,” or “our”), governing your access to and use of www.porcellinomeats.com (the “Site”) and, to the fullest extent permitted by law, your purchase, receipt, handling, consumption, or other use of any products sold or distributed by Porcellino, whether obtained directly through the Site or through third-party retailers, distributors, wholesalers, gift recipients, or other channels.
By accessing the Site, placing an order, purchasing, receiving, or consuming Porcellino products, you affirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Site or purchase or consume Porcellino products.
These Terms are governed by the laws of the State of Colorado.
1. ELIGIBILITY AND ACCEPTANCE
You represent and warrant that you are at least eighteen (18) years of age and legally capable of entering into a binding agreement. Use of the Site constitutes acceptance of these Terms regardless of whether you create an account or complete a purchase.
Porcellino reserves the right to modify, amend, or update these Terms at any time in its sole discretion. Changes are effective immediately upon posting to the Site. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
2. PRODUCTS, FOOD SAFETY, AND ASSUMPTION OF RISK
Porcellino Artisanal Meats, LLC manufactures and sells food products, including cured and specialty meats. Certain products may be produced for Porcellino by third-party producers operating under agreement with Porcellino and in accordance with applicable food safety and regulatory requirements.
By purchasing, receiving, handling, consuming, or otherwise using any Porcellino product, whether obtained directly through this Site or indirectly through third-party retailers, distributors, wholesalers, gift recipients, resale channels, or other means, you acknowledge and agree that:
• Food products carry inherent risks, including spoilage, allergic reactions, and foodborne illness if improperly stored, handled, or consumed
• Proper storage, handling, preparation, and consumption of products are the responsibility of the purchaser and any subsequent recipient once the product leaves Porcellino’s control
• Products may contain or be produced in facilities that handle common allergens
You voluntarily assume all risks associated with the handling, storage, preparation, and consumption of Porcellino products, regardless of the method of purchase, production, or transfer, to the fullest extent permitted by law.
Product descriptions, labels, and content are provided for general informational purposes only and do not constitute medical, dietary, or health advice.
3. ORDERS, PAYMENTS, AND PRICING
All orders placed through the Site are subject to acceptance by Porcellino. No order is binding until accepted and processed.
Payments are processed through Shopify and its authorized third-party payment processors. By submitting payment information, you represent and warrant that you are authorized to use the selected payment method.
Porcellino reserves the right, in its sole discretion, to refuse or cancel any order, correct errors related to pricing, descriptions, or availability, and limit quantities purchased per order, household, or customer.
Prices are listed in U.S. dollars unless otherwise stated and are subject to change without notice.
4. SHIPPING AND REFUND POLICIES INCORPORATED BY REFERENCE
All matters related to shipping, delivery, refunds, replacements, cancellations, and related issues are governed exclusively by Porcellino’s Shipping Policy and Refund Policy, which are incorporated into these Terms by reference.
By placing an order, purchasing, or receiving Porcellino products, you acknowledge that you have reviewed, understood, and agreed to those policies. In the event of any conflict, the Shipping Policy or Refund Policy controls for those specific matters.
5. INTELLECTUAL PROPERTY RIGHTS
All content on the Site, including but not limited to text, product descriptions, branding, trademarks, logos, images, videos, animations, graphics, and design elements, is owned by or licensed to Porcellino Artisanal Meats, LLC and is protected by United States and international intellectual property laws.
Certain images, videos, or animations may be licensed stock media used under valid commercial licenses.
No content may be copied, reproduced, modified, distributed, displayed, transmitted, or used for commercial purposes without prior written consent from Porcellino.
6. USER CONDUCT AND PROHIBITED ACTIVITIES
You agree not to use the Site for any unlawful, fraudulent, or deceptive purpose, interfere with the security or proper functioning of the Site, attempt to gain unauthorized access to systems or data, use automated tools or scraping software, introduce malware or harmful code, or circumvent safeguards or access restrictions.
Porcellino reserves the right to suspend or terminate access to the Site at any time, without notice, for conduct that violates these Terms or is otherwise harmful to the Company.
7. THIRD-PARTY SOFTWARE, TOOLS, AND INTEGRATIONS
The Site may incorporate or rely on third-party software, tools, services, or integrations to support functionality, content delivery, analytics, mapping, e-commerce operations, or user experience.
These may include, without limitation, mapping and location services such as Mapbox, website and content tools such as Framer, e-commerce and payment services such as Shopify, analytics providers, hosting services, and other third-party technologies.
Porcellino does not control and is not responsible for the accuracy, availability, reliability, or functionality of third-party software or services. Such services are provided “as is” by their respective providers and may be subject to separate terms, licenses, or policies.
Your use of features powered by third-party software is at your own risk. Porcellino disclaims any liability arising from errors, interruptions, inaccuracies, failures, or downtime of third-party software, tools, or integrations to the fullest extent permitted by law.
This limitation and disclaimer apply to any claim arising from or relating to third-party software, tools, or services integrated into or used in connection with the Site.
8. DISCLAIMER OF WARRANTIES
THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE FULLEST EXTENT PERMITTED BY LAW, PORCELLINO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
PORCELLINO DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT PRODUCTS WILL MEET EVERY CUSTOMER EXPECTATION.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORCELLINO ARTISANAL MEATS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO THE SITE, PRODUCTS, OR THESE TERMS.
IN NO EVENT SHALL PORCELLINO’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE APPLICABLE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Porcellino Artisanal Meats, LLC, its owners, officers, employees, contractors, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use or misuse of the Site, your purchase, handling, or consumption of Porcellino products, your violation of these Terms, or your violation of any applicable law or regulation.
This indemnification obligation survives termination of these Terms.
11. INTERNATIONAL USERS
The Site and services are intended solely for users located in the United States. Porcellino does not market to or intentionally offer goods or services to individuals outside the United States.
If you access the Site from outside the United States, you do so at your own initiative and consent to the transfer, storage, and processing of your information in the United States, where data protection laws may differ from those in your jurisdiction.
12. GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located within the State of Colorado, and you irrevocably consent to such jurisdiction and venue.
13. SEVERABILITY AND WAIVER
If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.
Failure by Porcellino to enforce any provision shall not be deemed a waiver of future enforcement.
